Can You Face Sex Crime Charges if a Minor Lied About Their Age?

You can face charges in Illinois in 2026 even if a minor lied about their age, even if the lie was convincing. But Illinois does recognize a reasonable mistake-of-age defense for certain sexual abuse offenses. The exception depends on the specific charge and the ages of both people. For other offenses, a fake ID or an adult age listed on a dating profile does not automatically protect you. A Cook County sex crimes defense lawyer can explain what defense strategies may apply to your situation.

When Does Illinois Allow a Mistake-of-Age Defense in a Sex Crime Case?

Illinois addresses this in 720 ILCS 5/11-1.70, which sets out defenses for certain sexual assault and sexual abuse charges. For certain charges, you can defend yourself by showing that you reasonably believed the other person was at least 17.

One exception involves criminal sexual abuse when the accused is less than five years older than someone aged 13 through 16. Another covers certain conduct between people under 17. Importantly, the exception also applies to aggravated criminal sexual abuse involving a person aged 13 through 16 when the accused is at least five years older.

These exceptions do not apply to every sexual offense. A claim that someone looked older, used a fake ID, or stated an adult age needs to be evaluated against the exact charge. Even where the defense is available, the question is whether the belief was reasonable under the circumstances.

Does Illinois's Age of Consent Change for Teachers and Other Authority Figures?

Illinois generally sets the age of consent at 17. But certain relationships create additional protections for people under 18. Under Illinois criminal sexual assault law, a person aged 17 or older who holds a position of trust, authority, or supervision can face charges for sexual penetration involving someone aged 13 through 17.

Teachers, coaches, and other authority figures can fall within this rule when the required relationship exists. The law also separately addresses sexual conduct involving family members under 18. An accusation depends on the relationship, the alleged conduct, and the relevant ages, not just someone's job title.

What Illinois Sex Crime Charges Can Involve a Minor Who Lied About Their Age?

The possible charge depends on the alleged conduct, both people's ages, and other circumstances. Examples include:

  • Criminal sexual assault, including certain family and authority relationships

  • Aggravated criminal sexual abuse, including certain age differences

  • Criminal sexual abuse, where a limited age-mistake defense can apply

  • Grooming, which has specific age-gap or authority requirements under the law effective in 2026

  • Traveling to meet a child for unlawful sexual activity

  • Indecent solicitation of a child or solicitation to meet a child

  • Offenses involving child sexual abuse material

Penalties range from misdemeanors to serious felonies. Some convictions require sex offender registration, which can affect housing, employment, and daily life.

What Defenses Are Available When a Minor Lies About Their Age in Illinois?

Even when being mistaken about someone’s age is not a defense, prosecutors still have to prove every part of the charge beyond a reasonable doubt. Age records matter when the charge depends on someone's age, especially when alleged events span a birthday.

Your lawyer can also question whether the alleged acts happened or whether you were the person involved. Messages, location records, and gaps in someone’s story can help challenge the accusation.

Some charges require proof that you acted with a specific purpose. Your messages and the surrounding circumstances can help show what you intended and what you believed about the other person’s age.

Unlawful device searches or improperly obtained statements can also be challenged. In undercover cases, entrapment requires more than an officer starting a conversation. The key questions are whether police persuaded you to commit the crime and whether you were already willing to commit it.

What Should You Do if Police Investigate an Illinois Sex Crime Involving a Minor?

Do not speak with investigators without a lawyer present, even to explain that you were deceived. Statements intended to clear up a misunderstanding can confirm facts that prosecutors later use.

Do not contact the other person, their family, or anyone connected to them. Preserve your devices and accounts. Deleting messages after learning of an investigation can hurt your defense and lead to additional charges.

Save everything that supports your account. This includes profile screenshots, the complete message history, and any identification you were shown. Write down who else had access to your devices and accounts.
